Topic: Help me figure out vengeance for my friend (no, seriously)

My old colleague and good friend Jessica Hernandez was hired to edit a documentary about Benazir Bhutto about 2 years ago.  She was promoted to Co-Director of the film (with Johnny O'Hara) by the producer because she kicks ass at her job and was a consumate professional.  She single handedly restructured the movie, and the producer, Duane Baughman, was in no short supply of praise for her.  The film made it into Sundance 2010 where it screened, Duane praised her as "The best editor in America" and got a deal with PBS.  It makes its theatrical premiere this weekend.  Except Jessica's name has been removed from the credits as Co-Director.  O'Hara's name is there...as well as Duane Baughman, now sharing Director credit.  She retains her Editor credit, but she did so much more than that.

The reasons for which are total bullshit.  In a public forum, I'm not sure I'm allowed to say.  Lets just say its equal parts vanity and global politics.  But legally there's nothing she can do.  Even though at Sundance and in all the early press events she's listed as Co-Director, Duane is the one doing all the press.

My question is, what can be done virally to spread the word about this?  She's not after fame or money (it's documentary filmmaking afterall) she just wants the due respect for her work.

There are two ways she can get recognition. First is to persuade Duane to put her name back on as Co-Director. The second is to create a loud scandal that tells everyone what she did on the film, a viral message that tells the story behind the story. The two are mutually exclusive, and the latter course is an awful idea.

Even if the reasons behind Duane's turnabout are bullshit,  going behind his back is going to rub the right people up the wrong way. She might be the greatest editor in world, but if she gets a reputation as 'that woman who raised a stink about being co-director', then her career could suffer. Especially so if the reasons aren't credit-stealing bullshit and more "well, she was only in the editing room and didn't actually direct anything". If she tries to damage Duane's reputation then he'll just come after her - and that's a battle she'll lose.

And there's no guarantee that her story will even be heard by those she wants it to reach. I bet Jessica isn't the only person to feel that she's getting short-changed, but I've never heard a story where, say, some assistant DoP finally achieved recognition for the look of a film he felt he influenced more than the DoP.

If she can't persuade Duane to give her due recognition, then she should just take the editor credit and move on. It's just not worth it at this point in her career. And yeah, don't work with the arsehole again.

Speaking as someone with no film experience, why not just put it in her demo reel (or the like). Have future employers see it and make of it what they will.

This is feature directing.  You dont cut demo's and do interviews.  If she claims she's a director, and they go to IMDB and see no Director credit, it kills her credibility.  Likewise if she DOESN'T list it, she loses out on her first Director credit, which is always the hardest to get with real films.

If this was a joking matter I'd ask if Asylum was hiring smile

But, being out of my depth, I'll just ask if editors can get a directing credit (or even a writing one) if what comes out is different enough from what went in. Although, now that I think of it, for a documentary most of what a director would be doing is arranging the footage, so... I'll go away now.

Keep in mind the Director credit was given by the same producer that took it away.  It went to Sundance with her name as Director.

That's pretty foul. Since there's nothing she can do contractually and the prints are struck, the best course of action off the top of my head would be to contact IMDb with the video where's she's mentioned as director and make a case for her to get her listed as such, but uncredited.

I just listened to the review for this on AirTalk yesterday. When Larry Mantle first introduced the film he said it was directed by Baughman and Johnathan O'Hara. But when he went to say O'Hara's name, it sounded like he started to say "Jessica" before he caught himself.

Anyway, I'm sorry to say I'm not sure if an official recourse does exist, other than to simply make sure the story gets told in the right professional circles. It's a small town and all that and eventually repercussions will land. Unsatisfying, yes, but it does sound like the other options proposed will only bring more hurt to your friend and, as unfair as it is, I agree that if she makes a stink, she won't come off in the most flattering of light.

But that's definitely one to add to the register of "Great Stories of Hollywood Fuckery."

The DGA usually opposes co-director situations for this among other reasons, but discourse with someone from there, or anyone who deals with arbitration may provide some ideas.

Oh, look.  Someone named "AstroninjaStudios" (no relation myself of course...there's a space between the two words on MY name) has posted a video of the Sundance screening where Duane refers to Jessica as the Co-Director several times.
